REGULATIONS

The purpose of this document is to inform our guests of the terms and conditions of operation of PYR-SOLUTIONS Madrid.The client will sign a rental agreement before checking-in the selected property.The services provided by PYR-SOLUTIONS will be paid at the time of booking the selected flat.This document will focus on explaining the conditions and the procedure for contracting the service.

Hiring process

This document will be public so that the client has access to the information easily.

It will be considered that the hiring process begins at the same time that the client signs a contract for the transfer of a property or rental with PYR-SOLUTIONS, applying the privacy policy from that precise moment.

PYR-SOLUTIONS considers both lessor (owners, managers) and tenants (individual and collective) as clients, and therefore, both will be treated as such during the relationship.

PYR-SOLUTIONS makes the information about the company, conditions and real estate available to customers through the website. This information can be shared by the client to other people under the same conditions and only through sharing links to our pages.

Booking process

PYR-SOLUTIONS establishes different booking conditions according to the type of rental in the modalities of: vacation / tourist, student / master / exchange or executives / expatriates. You will be informed by our agents before making any payment.

PYR-SOLUTIONS Madrid establishes the booking payment. This reservation must be satisfied to receive confirmation that the flat is already booked. The amount of the reservation may be different for each apartment and period.

To make a booking it is necessary to pay one month of the chosen flat. In exceptional cases, we would admit 30% of the monthly payment, making the remaining payment of 70% always before check-in.

Payment methods

The payment will be made through bank transfer by sending the receipt as soon as possible or in cash at our office.

Documents receipt and rest of the reserved rent

PYR-SOLUTIONS will receive the necessary documentation for proper identification of the client, as well as the employment contract, the notice of admission from the school or any other document, which according to the rental modality is necessary to justify the stay.

PYR-SOLUTIONS will send to the client, after receiving the booking payment and documentation, the summary of bill payable upon check-in and during the term of the contract. PYR-SOLUTIONS will keep communication with the client by email about the necessary issues during the term of the contract.

If the flat is managed by PYR-SOLUTIONS Madrid or belongs to PYR-SOLUTIONS Madrid, booking payments, fees, check-in and recurring payments will be made to PYR-SOLUTIONS directly through the indicated payment method.

If the flat belongs to an owner and PYR-SOLUTIONS is a mediator or intermediary, the booking payment and fees will be made to PYR-SOLUTIONS on behalf of the property. However, deposit and monthly payments will be made directly to the owner.

Rental fee payments

PYR-SOLUTIONS charges one rent + VAT in long-term agreements under services fees, for agreements of less than 5 months the proportional part + VAT will be charged.

Change policy

PYR-SOLUTIONS cannot guarantee the availability of a flat if after the booking the client modifies the dates.

If the request for the change of dates happens due to a justified cause that prevents your trip to Madrid, PYR-SOLUTIONS Madrid commits to seek an alternative for the recovery or use of the money in our services.

Change policy and no show

The amount of the booking is not refundable in case of cancellation.

In case of no-show, in daily agreements PYR-SOLUTIONS will charge the entire stay with a maximum of 7 days for the loss caused by the reservation made by the client. In case of monthly agreements, the deposit will not be refunded.

Flats check-in and check-out time

The client is required to communicate his arrival time to the flat at least 3 days in advance. In case of notifying with less time PYR-SOLUTIONS will send an agent the agreed day of the check-in to the flat communicating to the client the time at which the delivery will be made, in this case the compliance with the client’s time of interest is not ensured.

PYR-SOLUTIONS establishes the following schedule for the check-in and check-out from Monday to Friday (weekdays) between 10:00 and 20:00, at no additional cost. Saturdays, Sundays and local holidays between 10:00 and 20:00, with additional cost, the client will be informed about the payment to be make upon arrival in the information e-mail.

Outside established conditions, it will be possible to check-in and check-out outside the indicated hours, exceptionally and with prior notice by the client paying the corresponding additional cost.

Guests

In the case of the need to modify the guests staying in a flat, the communication must be carried out as soon as possible, PYR-SOLUTIONS only recognises as guests the people listed in the agreement. Reserving the right to take appropriate legal action if necessary in order to ensure compliance with the contract.

Processing of personal data

Personal data provided will be processed by PYR-SOLUTIONS Servicios de Alojamiento, SL (domiciled at Padre Jesús Ordoñez, 18 1st left) and will eventually be incorporated into a database to comply with our legal obligations, respond to your request and improve our service.

Rectification / Deletion of personal data information

For the exercise of the rights of access, rectification, cancellation and opposition, kindly direct your written request to info@pyr-solutions.es  by proving your identity (copy of your ID, NIF or Passport). Also you can exercise your right by sending a letter with your data and ID copy to the address indicated above.

Navigation information and cookies

All websites owned by PYR-SOLUTIONS make use of tracking systems such as the use of cookies or plugins like Google Analytics. The intention of PYR-SOLUTIONS is to track customer behavior on the website in order to improve our services and measure the level of success of our designs.

Google Analytics, dependent on Google Inc., stores this information and makes it available to PYR-SOLUTIONS Madrid through its analysis tools. Neither Google or PYR-SOLUTIONS Madrid will share with third parties unauthorized private information such as names or IP addresses that identify the client, but they do reserve the right to share the knowledge extracted from the navigation mode from the client's navigation on the web.

Legal

Type of agreement

PYR-SOLUTIONS offers different rental modalities according to the requirements of the lessee, lessor, terms and applicable legislation for each case:

  1. Rental agreement that is regulated by articles 1542 and following of the Civil Code of Spain; Property leases are also regulated by specific regulations: the LAU Urban Leases Law and the Rustic Leases Law (49/2003) LAR. Several articles of the Urban Leasing Law have been modified with Law 4/2013 on Measures of Flexibility and Promotion of the Housing Rental Market, 4 published in the BOE on June 5, 2013.
  2. Seasonal agreement when the primary purpose is a different one to meet the permanent need of the tenant's housing. It will be regulated by the will of the parties, failing that by the provisions of Title III LAU 1994 and, additionally, by the provisions of the Civil Code (arts. 1, 2.1, 3 and 4.3 LAU). In any case, and in accordance with the provisions of art. 4.1 LAU, the common provisions contained in Title IV (deposit and rental formalisation) and in Title V (lease processes) of the LAU shall be mandatory.
  3. Tourist agreement when the stay does not correspond to any of the above. Lodging is one of the so-called atypical agreements because it does not have its own regulation, neither in the Civil Code or in the Commercial Code but with a growing and extensive administrative regulation about the accommodation and the outputs related to it.

3.2. Bills

All our prices for accommodation and for our additional services include VAT in effect (as of June 2014, 10% for tourist agreements, exempt from VAT for housing ones, 21% for service provision).

PYR-SOLUTIONS manages flats of individuals who do not have knowledge, capacity or interest in managing quarterly VAT returns and, therefore, do not admit company clients or autonomous clients that require invoices and only admit individuals. It is the responsibility of the client to inform in advance of his invoice need before making his booking

3.3. Responsibilities

Neither PYR-SOLUTIONS nor the owners of the flats will be responsible for any damages that may occur during your stay in the apartment, including and without limitation, personal injury, death or loss, whether due to fire, theft or flooding or due to the irresponsibility of the client, the unauthorized access of a person to the apartment or the misuse of the elements included in the accommodation.

In the case that you have a confirmed booking and PYR-SOLUTIONS cannot accommodate you in the flat you chose, the responsibility of PYR-SOLUTIONS Madrid will be to provide you with accommodation in a similar flat or to the full refund.

PYR-SOLUTIONS Madrid makes an effort to accurately describe our flat. If a dispute regarding the description of the apartment arises, the responsibility of PYR-SOLUTIONS Madrid will be limited to refund the amounts paid, less the cost of the days of stay, if you decide not to stay in the flat.

3.4. Conflict resolution

For any conflict about our services, Spanish legislation will be applied, from the Courts and Tribunals of Madrid, or the Madrid Arbitration Court (Law 60/2003, of December 23, on Arbitration (BOE nº 309/12/2003) ).

Behaviour rules

PYR-SOLUTIONS offers different rental modalities according to the requirements of the lessee, lessor, terms and applicable legislation for each case:

  1. Rental agreement that is regulated by articles 1542 and following of the Civil Code of Spain; Property leases are also regulated by specific regulations: the LAU Urban Leases Law and the Rustic Leases Law (49/2003) LAR.
